(FAYETTEVILLE, N.C.) - The Fayetteville City Council met Nov. 27 at 7:00 p.m. in the City Hall Council Chambers to discuss matters relevant to the city to discuss matter relevant to Fayetteville residents.  

The meeting was called to order at 7:05 p.m., followed by a prayer offered by Councilmember D.J. Haire, and then the Pledge of Allegiance lead by Mayor Pro Tem Johnny Dawkins. 

There were several ANNOUNCEMENTS AND RECOGNITIONS made by the Mayor Pro Tem and Council. 

  • Dr. Telly Whitfield, MetroNet Governmental Affairs Director declared Fayetteville as a Certified Gigabit City, the first in North Carolina and seventh in the nation; and presented an award to the City Council and Robert Van Geons, President of the Fayetteville-Cumberland Economic and Development Board.   
  • Certificates of Achievement were presented to the players of the Prime Time Elite Bulldogs in recognition of being the Conference, State, and Regional Football Champions. They will be playing for the National Championship title on Dec. 2–10, 2023 in Florida. 
  • The Key to the City was presented to Council Member Shakeyla Ingram in grateful recognition of her devoted interest and untiring commitment to the citizens of Fayetteville while serving as the Dist. 2 Council Member from 2019-2023. 
  • A Letter of Appreciation was presented to Mayor Pro Tem Dawkins in grateful recognition of his interest and untiring commitment to the citizens of Fayetteville while serving as the Dist. 5 Council Member 2017–2022 and Mayor Pro Tem from 2022–2023. 
A motion was made to Approve the Agenda by Council Member Shakeyla Ingram with the exception of Items 7.08, 7.010, and 10.01. This included setting a public hearing on Jan. 8, 2024. Council Member Derrick Thompson seconded the motion and it PASSED (8-1) with Council Member Courtney Banks-McLaughlin in opposition.

  • 7.08       P23-47. Rezoning of 1.86 acres ± from Mixed Residential 5 (MR-5) to Downtown 2 Conditional (DT-2/CZ), located at 344, 348, 352 Hawley Lane and unaddressed Plummers Lane (REID# 0437848219000, 0437848347000, 0437848464000, 0437849540000), and being the property of Cumberland County Board of Education, Michael J Carpenter and Helen Kelly Heirs, represented by Jimmy Kizer, Moorman, Kizer & Reitzel, Inc. and Jermaine Walker, Cumberland County. The City Council acted on 16 CONSENT AGENDA items during this meeting. The Consent Agenda is a group of items that are considered routine whereby all items are passed with a single motion and vote. Members of City Council can remove items from the Consent Agenda for further discussion prior to voting. Council Member Ingram moved to approve consent agenda which was seconded by Council Member Mario Benavente. It was approved UNANIMOUSLY (9-0).

Initial zoning of one non-contiguous parcel totaling 21.05 ± acres, requested annexation, to Mixed Residential 5 (MR-5) located at 0 Jossie Street (0520795388000), being the property of Joseph Griffin Sr. Revocable Trust Agreement, represented by R. STAFF REPORTS 

Three reports were presented by City Staff to the Council. 

  • The Development Services Director provided an update on 5002 Collins Street. Councilmember Hondros moved to accept the report, seconded by Councilmember Haire. The vote was UNANIMOUS (9-0). You can read more about this item here. 
  • The Fayetteville Fire Chief and an Assistant Chief presented the Fayetteville Fire Department 2023 Third Quarter Review. Councilmember Thompson moved to accept the Fire Department 2023 Third Quarter Review, seconded by Council Member Haire. The vote was UNANIMOUS (9-0). You can read more about this item here.  
  • The Fayetteville Police Chief and the Director of the Phoenix Center presented the Fayetteville Police Department 2023 Third Quarter Review. Councilmember Ingram moved to accept the Police Department 2023 Third Quarter Review, seconded by Councilmember Thompson. The vote was UNANIMOUS (9-0). You can read more about this item here. 
The City Council held two PUBLIC HEARINGS during this meeting. This is a critical portion of the Regular Council meeting since for certain issues, the Fayetteville City Council may sit as a quasi-judicial body that has powers resembling those of a court of law or judge. The Council will hold hearings, investigate facts, weigh evidence and draw conclusions which serve as a basis for its decisions. All persons wishing to appear before the Council should be prepared to give sworn testimony on relevant facts.  

The first was AX23-05: The owners of the following address petitioned to annex into the corporate limits of the City of Fayetteville one contiguous parcel totaling 21.05 ± acres.  This parcel is located on the eastern side of McArthur Road at 0 Jossie Street and can be further identified by PIN#: 0520-79-5388 and REID#: 0520795388000. This item was presented by Mr. Demetrios Moutos, Planner I.  

There was one speaker in who spoke in favor of this item and none in opposition. 

Council Member Jensen moved to adopt the proposed ordinance annexing the parcel with an effective date of Nov. 27, 2023 and establish the initial zoning consistent with prior action taken by council concerning the map amendment. This was seconded by Council Member Thompson. The vote was UNANIMOUS (9-0).  You can read more about this item here. 

The second was AX23-06: Fulcher Real Estate, LLC and Garret L. Fulcher petitioned to annex into the corporate limits of the City of Fayetteville three non-contiguous parcles totaling 13.84 ± acres.  These parcels are located on the northwestern side of Middle River Loop at 1476, 1446, and 1416 Middle River Loop and can be further identified by PIN #’s: 0447-67-2620, 0447-67-3767, and 0447-68-3174, and REID#’s: 0447672620000, 0447673767000, and 0447683174000. This item was also presented by Mr. Demetrios Moutos, Planner I.  

There was one speaker in who spoke in favor of this item and none in opposition. 

Council Member Ingram moved to adopt the annexation ordinance with an effective date of Jan. 8, 2024, this option validates the final action taken by Council on the initial zoning. This was seconded by Council Member Hondros. The vote was UNANIMOUS (9-0). You can read more about this item here.  

OTHER ITEMS OF BUSINESS 

During the Other Items of Business portion of the meeting, the City Council discussed the Single-Family Housing Development Loan for Kingdom CDC’s Rosehill Road Project. This item was presented by the Economic and Community Development Director. 

Council Member Benavente moved to authorize a loan commitment letter and subsequent loan documents an amount not to exceed $725,000 from the City’s American Rescue Plan Act funds allocated for housing to the proposed Rosehill Road Development. This was seconded by Council Member Haire. The vote was UNANIMOUS (9-0). You can read more about this item here.   

ADMINISTRATIVE REPORT  

The Fiscal Year 2024 First Quarter City Council Scorecard was submitted as an ADMINISTRATIVE REPORT. This report was not presented.
