(FAYETTEVILLE, N.C.) - The Fayetteville City Council met May 22 at 7 p.m. in the City Hall Council Chambers to discuss matters relevant to the city in order to Fayetteville forward.
The meeting was called to order at 7:10 p.m. The invocation was offered by Father Gregory Lowchy with Saint Patrick Catholic Church followed by the Pledge of Allegiance lead by Mayor Mitch Colvin.
There were several ANNOUNCEMENTS AND RECOGNITIONS made by the Mayor Pro Tem and Council.
- Mayor Mitch Colvin presented a proclamation for Asian-American and Pacific Islander Heritage Month to Mr. Hyun Chul Kim, President of the Korean Chamber of Commerce.
- Mayor Mitch Colvin presented a proclamation for National Public Works Week to Mr. Daniel Edwards Public Services Assistant Director, Mr. Byron Reeves, Public Services Assistant Director, and Mr. Brian McGill, Deputy City Traffic Engineer
- Council Member D.J. Haire presented a Certificate of Excellence to Mr. Dykashie Harris for his hard work and outstanding performance as State Champion Bowler
- Mayor Mitch Colvin recognized and presented the North Carolina Public Transportation Association Transit Advocate Award to Mr. Austin Campbell. This award honors individuals and organizations who have championed the goals, services, and cause of public transportation in North Carolina.
- Mayor Pro Tem Johnny Dawkins stated this week marks the 50th anniversary of the end of the Vietnam War. He thanked all Vietnam Veterans and welcomed them home.
- Mayor Pro Tem Johnny Dawkins stated this week is All American Week on Fort Bragg and thanked soldiers for all they do.
- Council Member Shakeyla Ingram stated the line-up for Juneteenth has been announced and invited everyone to attend.
The City Council acted on nine CONSENT AGENDA items during this meeting. The Consent Agenda is a group of items that are considered routine whereby all items are passed with a single motion and vote. Members of City Council can remove items from the Consent Agenda for further discussion prior to voting. A motion was made by Council Member Council Member D.J. Haire moved to approve consent agenda and pulled Item 7.05 for presentation and separate vote and seconded by Mayor Pro Tem Johnny Dawkins. This motion was approved unanimously.

The City Council held several PUBLIC HEARINGS during this meeting. This is a critical portion of the Regular Council meeting since for certain issues, the Fayetteville City Council may sit as a quasi-judicial body that has powers resembling those of a court of law or judge. The Council will hold hearings, investigate facts, weigh evidence and draw conclusions which serve as a basis for its decisions. All persons wishing to appear before the Council should be prepared to give sworn testimony on relevant facts.
- New Design Standards for the locally designated historic districts and local landmarks to comply with Chapter 160D of the North Carolina General Statutes. Council Member Jensen moved to table this item to the next available work session which was seconded by Mayor Pro Tem Johnny Dawkins. - AX23-02: Charles F. Horne, Billy D. Horne, and Fay J. Horne are petitioning to annex into the corporate limits of the City of Fayetteville and initially zone two parcels, a total of 4.68 ± acres to Heavy Industrial Conditional Zoning (HI/CZ). These parcels are located on the northern side of I-95 at 1682 and 1662 Middle River Loop and can be further identified by PIN: 0447-46-4759 and 0447-46-6947; REID: 0447-46-4759000 and 0447-46-6947000. Council Member Derrick Thompson moved to approval of the map amendment to MR-5 as presented based on the evidence submitted and finds that the rezoning is consistent with the Future Land Use Plan as demonstrated by the attached consistency and reasonableness statement. - SUP23-04. Special Use Permit to allow a duplex in the Single-Family Residential 15 (SF-15) zoning district on property located at 105 Arbor View Court (REID # 0427471706000) and owned by Nikki Creecy, Shinelight Properties, LLC. Mr. Craig Harmon presented this item.
- Mayor Pro Tem Johnny Dawkins moved to deny the Special Use Permit because the special use will be in harmony with the area in which it is located, seconded by Council Member Mario Benavente. This motion FAILED (5-5). Council Members in opposition were Council Members Shakeyla Ingram, Brenda McNair, Courtney Banks-McLaughlin, Deno Hondros, Mitch Colvin.
- Council Member Courtney Banks-McLaughlin moved to approve the special use permit based on the six findings of fact which was seconded by Council Member Shakeyla Ingram. The motion FAILED (5-5). Council Members in opposition were Council Members Kathy Jensen, Mario Benavente, D.J. Haire, Johnny Dawkins, Derrick Thompson.
- Council Member Kathy Jensen moved to table to allow both parties to have conversation and come back in thirty days. No one seconded the motion. The motion died for lack of a second.
- Council Member Shakeyla Ingram moved to table this item for thirty days. This was seconded by Council Member Kathy Jensen. The motion PASSED (7-3). Council Members in opposition were Council Members Johnny Dawkins, Mario Benavente, Derrick Thompson.
- SUP23-05. Special Use Permit (SUP) to allow the construction of 42 townhomes (single family attached units) on property zoned Single-Family 6 Residential (SF-6) located on Old Bunce Road (REID #9497843830000) and being the property of King Model Homes Construction Co. Inc., Project owner Ben Stout, Stout Land Development, LLC., applicant Scott Brown, 4D Site Solutions, Inc. Mr. Craig Harmon presented this item. Council Member Brenda McNair moved to approve the special use permit based on the six findings of fact. Council Member Mario Benavente seconded the motion. The motion passed unanimously.
